Ontario Veggies — Ontario Veggies Inc., operating in Niagara-on-the-Lake and Hamilton, Ontario, Canada.
This policy explains how to cancel an order, pre-order, CSA share subscription, or farmers’-market reservation, and what refund treatment applies to each. Because we sell perishable fresh produce, cancellation windows are time-sensitive: once we have harvested and packed your order, we cannot re-sell those goods, so late cancellations may not be refundable.
This policy should be read alongside our Refund & Return Policy and Shipping & Delivery Policy, and is subject to the Ontario Consumer Protection Act, 2002 (CPA).
1. How to Cancel
All cancellation requests must be submitted in writing:
- Email: office@ontarioveggies.com — include your name, order number or reference date, and the word “CANCELLATION” in the subject line.
- We will confirm receipt of your cancellation request by email within 1 business day.
- A cancellation is not confirmed until you receive written acknowledgement from us.
2. One-Time / Single Orders (Farm-Gate, Market, or Online)
These are individual orders for a specific pickup or delivery date.
| Scenario | Cancellation window | Outcome |
|---|---|---|
| Cancelled before the order cut-off | 48 hours before scheduled pickup or delivery | Full refund |
| Cancelled after the cut-off but before packing | 48 hours | a partial refund or store credit, assessed case by case |
| Cancelled after packing has begun | Not cancellable | No refund — produce has been harvested and packed for your order |
| No-show (pickup not collected within the window) | n/a | No refund — perishable goods cannot be held indefinitely |
Cut-off times per channel:
- Farm-gate pickup: 48 hours before scheduled pickup date
- Farmers’-market reservation: the day before market day at 6 pm
- Local delivery: 48 hours before scheduled delivery date
3. Pre-Orders (Future-Season or Advance-Harvest Orders)
Pre-orders allow you to reserve produce before the harvest date. A deposit or full payment may be collected at the time of pre-order.
Cancellation with full refund
You may cancel a pre-order for a full refund if you cancel at least 7 days before the stated fulfilment date.
Cancellation with partial refund / deposit forfeiture
If you cancel between 2–6 days before the fulfilment date, we may retain a portion of the payment to cover harvest and packing costs already incurred. A non-refundable deposit of 20% of the share price reserves your spot.
Late cancellation (within 48 hours of fulfilment)
Once packing has begun, cancellations are not accepted and no refund is issued.
Grower-initiated cancellation
If we must cancel a pre-order due to crop failure, weather damage, or other circumstances beyond our control, you will receive a full refund of any amount paid. We are not liable for consequential losses arising from a grower-initiated cancellation.
4. CSA Shares (Community-Supported Agriculture)
Ontario Veggies offers a seasonal CSA (Community Supported Agriculture) program. Members subscribe before the season for a weekly share of the harvest. A deposit may be required to reserve a share, with the balance due before the season begins. Cancellation terms are set out below; because shares reflect harvest commitments made on your behalf, refunds for mid-season cancellations may be limited.
Placeholder outline (do not publish until programme is finalised):
- Before season begins (at least 2 years before first share): Full refund of any payments made.
- Within 2 years of season start: Partial refund, less the non-refundable deposit.
- After season has begun: A pro-rated credit for the remaining shares, at our discretion, reflecting harvest commitments already made. Note: the CPA may grant additional rights for prepaid contracts; confirm with counsel.
- How to cancel a CSA: Same written-email process described in section 1.
5. Farmers’-Market Reservations
Items reserved for market-day pickup are held from general sale specifically for you.
- Cancel by the day before market at 6 pm: Full refund of any deposit or pre-payment.
- Cancel after cut-off or no-show at market: No refund. Reserved perishable stock cannot be held past market close.
If exceptional circumstances prevent you from attending (e.g., medical emergency), contact us as early as possible at office@ontarioveggies.com and we will consider a credit at our discretion.
6. Order Modifications
If you wish to reduce quantity (partial cancellation) or change items rather than cancel entirely, please contact us at office@ontarioveggies.com. We will accommodate modifications if contacted before the applicable cut-off window. We cannot reduce a partially packed order.
7. Our Right to Cancel
We reserve the right to cancel any order, pre-order, or reservation in the following circumstances:
- Items ordered are no longer available due to crop failure, spoilage, or other production issues.
- Payment cannot be processed or is reversed.
- We reasonably suspect fraudulent activity.
- Force majeure events (extreme weather, public health emergencies, etc.) prevent fulfilment.
In all such cases, you will receive a full refund of any amount paid. We will notify you by email as promptly as possible.
8. Consumer Rights
Nothing in this policy limits or waives any rights you have under the Ontario Consumer Protection Act, 2002. Distance contracts (online orders) may carry additional statutory cancellation rights. If you believe your rights have not been respected, you may contact the Ontario Ministry of Public and Business Service Delivery or seek independent legal advice.
9. Refund Processing
Approved cancellation refunds are processed in accordance with our Refund & Return Policy — refunded to the original payment method via Square, typically within 5–10 business days depending on your card issuer. Cash purchases are refunded in cash.
