These Terms of Use (“Terms”) govern your access to and use of the Ontario Veggies website at https://ontarioveggies.com (“the Site”). Please read them carefully.
The Site is operated by Ontario Veggies Inc. (“Ontario Veggies”, “we”, “us”, or “our”), with farms in Niagara-on-the-Lake and Hamilton, Ontario, Canada.
1. Acceptance of Terms
By accessing or using the Site in any manner, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use the Site.
We may update these Terms from time to time. The date at the top of this page reflects the most recent revision. Continued use of the Site after any update constitutes your acceptance of the revised Terms.
2. Who May Use the Site
The Site is intended for users who are at least the age of majority in their province or territory of residence (18 in Ontario). By using the Site you represent that you meet this requirement. If you are using the Site on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.
3. Permitted Use of the Site
You may access and use the Site for lawful, personal, and non-commercial purposes consistent with these Terms. Specifically:
- The website (ontarioveggies.com) may be browsed to learn about Ontario Veggies products, contact us, and place orders or pre-orders.
You may not:
- Reproduce, republish, or create derivative works from Site content for commercial purposes without our prior written consent.
- Scrape, crawl, or systematically harvest content from the Site by automated means.
- Use the Site in any way that interferes with its normal operation or places an unreasonable load on our infrastructure.
- Misrepresent your identity or affiliation when contacting us.
4. Intellectual Property
All text, images, graphics, logos, and other content on the Site are owned by or licensed to Ontario Veggies and are protected under Canadian copyright law and applicable international treaties.
Nothing in these Terms grants you any right, title, or licence in our intellectual property beyond the limited reading and sharing permissions described in Section 3.

5. User Conduct
When interacting with the Site (including any contact forms, chat widgets, or linked social-media pages), you agree not to:
- Submit false, misleading, or fraudulent information.
- Transmit unsolicited commercial messages (spam) or engage in conduct that violates the Canada Anti-Spam Legislation (CASL).
- Post or transmit any content that is unlawful, defamatory, threatening, obscene, or infringing of third-party rights.
- Attempt to gain unauthorised access to any portion of the Site or our backend systems.
- Use the Site to distribute malware or engage in phishing.
6. Third-Party Links and Platforms
The Site may contain links to third-party websites, social-media pages (Facebook, Instagram, WhatsApp Business), or resources. These links are provided for convenience only. Ontario Veggies does not endorse, control, or accept responsibility for the content, privacy practices, or terms of any third-party site or platform. Your use of those sites is at your own risk and subject to their own terms.
7. Accounts and Orders
At present, Ontario Veggies does not require user account registration to browse the Site. If an order or pre-order system is introduced that requires account creation, additional terms will be presented at the time of registration.
For purchases and pre-orders, please refer to our Terms of Sale, which form a separate agreement between you and Ontario Veggies.
8. Disclaimers of Warranties
THE SITE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY ONTARIO AND CANADIAN LAW, ONTARIO VEGGIES DISCLAIMS ALL WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that:
- The Site will be uninterrupted, error-free, or free of viruses or other harmful components;
- Information on the Site is complete, accurate, or current;
- Any defects will be corrected.

9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ONTARIO VEGGIES, ITS OWNERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE SITE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR USE OF THE SITE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED CANADIAN DOLLARS (CAD $100).
Nothing in these Terms limits our liability for fraud, gross negligence, or any liability that cannot be excluded or limited under applicable Ontario or Canadian law.
10. Indemnification
You agree to indemnify, defend, and hold harmless Ontario Veggies and its owners, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from: (a) your use of the Site in violation of these Terms; (b) your violation of any applicable law or regulation; or (c) your infringement of any third-party rights.
11. Accessibility
Ontario Veggies is committed to making the Site accessible in accordance with the Accessibility for Ontarians with Disabilities Act (AODA) and strives to conform with WCAG 2.x Level AA guidelines. If you experience an accessibility barrier, please contact us at office@ontarioveggies.com and we will work to address it.
12. Changes to These Terms
We reserve the right to modify these Terms at any time. Material changes will be reflected by an updated “Last updated” date at the top of this page. We encourage you to review the Terms periodically. Your continued use of the Site following any change constitutes acceptance of the new Terms.
13. Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the Province of Ontario and the applicable federal laws of Canada, without regard to conflict-of-law principles.
Any dispute arising from these Terms or your use of the Site shall be subject to the exclusive jurisdiction of the courts of Ontario. We will try to resolve any dispute informally first; please contact us before pursuing other remedies.
14. Severability
If any provision of these Terms is found to be unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
