Ontario Veggies is committed to complying with Canada’s Anti-Spam Legislation (CASL, S.C. 2010, c. 23) in all commercial electronic messages (CEMs) we send. This document explains how we obtain and record consent, how we identify ourselves in every message, and how you can unsubscribe at any time.
1. What Is a Commercial Electronic Message?
Under CASL, a CEM is any electronic message (email, SMS, or a direct message through a service such as WhatsApp Business or Facebook/Instagram Messenger) sent to an electronic address that encourages participation in a commercial activity — for example, a promotional offer, a product announcement, a market schedule update, or a seasonal pre-order notice.
Transactional messages (e.g., an order confirmation or a direct reply to a customer enquiry) are not CEMs and may be sent without marketing consent, provided they do not contain unsolicited promotional content.
2. Consent
2.1 Express Consent
We will not send CEMs to a person unless they have given us express consent or we have a valid basis for implied consent (see Section 2.2). Express consent is obtained when a person:
- Ticks an opt-in checkbox on our website contact form or pre-order form requesting to receive newsletters or seasonal updates; or
- Verbally or in writing confirms they wish to receive promotional communications from us (for example, at a farmers’ market).
Express consent has no expiry date under CASL and remains valid until the person unsubscribes.
2.2 Implied Consent
CASL permits implied consent in certain circumstances. We rely on implied consent only where it is clearly available, including:
- Existing business relationship: A person who has purchased produce, placed a pre-order, or made a written enquiry with us within the previous two (2) years is presumed to have implied consent to receive CEMs related to our business during that period.
- Conspicuous publication: A person who has published their business email address publicly (without a statement that they do not wish to receive unsolicited CEMs) may receive one relevant CEM.
Implied consent expires after two years (or sooner if the person unsubscribes). We track consent expiry dates and will not send CEMs beyond the implied-consent window without obtaining express consent.
2.3 What We Do Not Do
- We do not purchase, rent, or obtain email lists from third parties.
- We do not pre-tick opt-in checkboxes.
- We do not treat silence or inaction as consent.
- We do not make provision of goods or services conditional on consent to receive CEMs beyond what is necessary.
3. Consent Records
We maintain records of consent for every person on our mailing list. Records include:
- The method by which consent was obtained (web form, in-person sign-up, etc.).
- The date and time consent was collected.
- The scope of consent (e.g., “seasonal updates and promotional offers from Ontario Veggies”).
- For implied consent: the nature of the relationship and the date it began.
These records are retained for the duration of the mailing relationship plus three (3) years after the last message sent, in case of a CASL complaint or CRTC investigation.
4. Sender Identification
Every CEM we send will clearly identify:
- Our name: Ontario Veggies
- Our mailing address: 6 Footbridge Cres, Brampton, ON L6R 0K5
- A contact address: office@ontarioveggies.com or alerts@ontarioveggies.com
Bulk emails are sent from our Migadu-hosted address alerts@ontarioveggies.com. The “From” name and reply-to address will always clearly identify Ontario Veggies as the sender.
5. Unsubscribe Mechanism
Every CEM we send includes a working unsubscribe mechanism. Specifically:
- Email: Every bulk or promotional email contains a one-click unsubscribe link in the footer. This mechanism is implemented and active. Clicking the link processes your unsubscribe request immediately without requiring you to log in, provide additional personal information beyond what is needed to identify your subscription, or complete additional steps.
- WhatsApp Business / Facebook Messenger: You may reply STOP (or an equivalent) to any promotional message, or contact us at office@ontarioveggies.com to be removed from our messaging list.
- Manual request: You may also unsubscribe by emailing privacy@ontarioveggies.com or office@ontarioveggies.com with the subject line “Unsubscribe”.
We will process all unsubscribe requests within 10 business days, as required by CASL. After processing, no further CEMs will be sent to that address or number unless new express consent is obtained.
We will not charge a fee, require the creation of an account, or impose any other condition on an unsubscribe request.
6. Scope: Email, WhatsApp, and SMS
CASL applies to CEMs sent to “electronic addresses,” which includes email addresses, telephone numbers used for SMS, and social-network accounts used for direct messaging. Our consent and unsubscribe obligations apply equally across all these channels:
- Email (via Migadu /
alerts@ontarioveggies.com): managed through our mailing-list tool with one-click unsubscribe. - WhatsApp Business: promotional messages sent only to customers who have provided their number and expressed or implied consent.
- Facebook/Instagram Messenger: promotional messages only where consent exists; reply STOP or contact us to unsubscribe.
- SMS We do not currently send SMS text messages; order updates are sent by email or WhatsApp.
7. Complaints
If you believe you have received a CEM from Ontario Veggies in violation of CASL, please contact us first at privacy@ontarioveggies.com so we can investigate and resolve the matter.

8. Changes to This Policy
We will update this policy as our practices or applicable law changes. The “Last updated” date at the top of this page reflects the most recent revision. This policy should be read together with our Privacy Policy and Cookie Policy.
